1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Poolbase platform, including the owner portal, player app, websites, and related services (collectively, the "Service") provided by Poolbase Ltd ("Poolbase", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Our Services

Poolbase provides pool table management software and optional hardware automation solutions (Basic and Premium plans) for pool table operators in Kenya. This includes queue management, timed games, payment processing via M-Pesa and card, analytics, and owner/admin tools.

3. User Accounts and Responsibilities

• You must provide accurate and complete information when registering or using the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• Store owners are responsible for all activities conducted under their account, including actions by attendants.

4. Payments and Commissions

Refunds and cancellations are subject to our cancellation policy. Once a game starts, no refunds are issued unless the table is faulty and reported immediately.

5. Player Conduct

Players must:

• Pay the correct amount before starting a game
• Not tamper with pool tables or Poolbase equipment
• Respect other players and venue rules
• Report any technical issues to the attendant or support immediately

6. Prohibited Activities

You agree not to:

• Attempt to reverse engineer, hack, or interfere with the Service
• Use the Service for any illegal purpose
• Share your account credentials with unauthorized persons
• Abuse the refund or dispute system
• Upload harmful code, viruses, or malicious content

7. Limitation of Liability

To the maximum extent permitted by law, Poolbase shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason we deem necessary. You may stop using the Service at any time.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
